Professional Liability

Professional Liability Insurance Coverage: Informational Memo (pdf) 

Insurance Carrier:

  • The University of Toledo Medical Assurance Company, SPC - Primary;
  • The University of Toledo Medical Assurance Company, SPC - First Excess;
  • CNA Insurance - First Reinsurer;
  • Medical Protective - Second Reinsurer.

Policy Limits:

  • $1,000,000 Each Claim/$3,000,000 Aggregate Limit - Primary;
  • $1,000,000 Each Claim/$2,000,000 Aggregate Limit - First Excess;
  • $15,000,000 First Reinsurance;
  • $10,000,000 Second Reinsurance.

Deductible:

  • $0. 

Coverage Provided:

  • Legal defense and settlement amounts/expenses arising from claims brought against the University and its healthcare employees, students and residents, based on injury to any person arising out of any negligent act, error, or omission in the rendering of healthcare services. Coverage applies to University healthcare students and residents in academically approved clinical experiences or rotations.
Automobile Liability

Insurance Carrier:

Policy Limits:

  • $1,000,000 Combined Single Limit (CSL), Bodily Injury (BI), and Property Damage (PD) per Accident/Loss;
  • $2,500 Medical Payments per Person, per Accident/Loss;
  • $1,000,000 CSL BI/PD Hired and Non-Owned per Accident/Loss. 

Deductible:

  • $100,000 per Occurrence. 

Coverage Provided:

  • Legal defense costs and settlements for bodily injury and/or property damage claims brought against the University and its employees from the operation of motor vehicles owned, leased, rented, or otherwise controlled by, or on the behalf of, The University of Toledo. For employees using personal vehicles for official business, this policy provides coverage excess to the employee's personal liability limits.   It is encouraged that the insurance coverage be obtained from rental agencies.  The University has a contract with Enterprise in which insurance is included in the rental fee.  Go to the Purchasing Department website for information on the Enterprise Car Rental Program.
Automobile Physical Damage

Insurance Carrier:

  • Inter-University Council - Insurance Consortium (IUC-IC) Property Pool.

Policy Limits:

  • Actual Cash Value. 

Deductible:

  • $1,000 Comprehensive - Scheduled and Hired Autos;
  • $1,000 Collision - Scheduled and Hired Autos.

Coverage Provided:

  • Affords coverage to specifically identified University vehicles (including buses) at a $1,000 deductible. Pays for expenses to repair or replace a vehicle for damages from comprehensive and/or collision exposures.  The IUC-IC also covers physical damage losses for vehicles which the University rents or leases on a short term basis from car rental organizations such as Avis, Enterprise, etc.  However, it is encouraged that the insurance coverage be obtained from the rental agency.  The University has a contract with Enterprise in which insurance is included in the rental fee.  Go to the Purchasing Department website for information on the Enterprise Car Rental Program.
Crime

Insurance Carrier:

  • National Union Fire Insurance Company of Pittsburgh.

Policy Limits:

  • $5,000,000 per Occurrence - Employee Dishonesty, Forgery or Alteration, and Computer Fraud;
  • $4,000,000 per Occurrence - Money and Securities Inside/Outside Premises;
  • $5,000,000 per Occurrence - Money Orders and Counterfeit Currency. 

Deductible:

  • $100,000 per Occurrence.

Coverage Provided:

  • Reimburses University for loss of money, checks, and drafts belonging to the University and protects the University against employee dishonesty, forgery, and computer fraud.
Cyber Risk Liability

Insurance Carrier:

  • Beazley (Syndicate 2623/623 at Lloyd's).

Policy Limits:

  • $5,000,000 Information Security & Privacy Liability;
  • $5,000,000 Cyber Extortion;
  • $2,000,000 Privacy Breach Response Coverage;
  • $5,000,000 Aggregate on all coverage.

Deductible:

  • $150,000 Deductible on liability;
  • $10,000 Deductible on Breach Response.

Coverage Provided:

  • Coverage is errors and omissions coverage with respect to theft, loss or unauthorized disclosure of private electronic data and the electronic systems that contain such information.  When private information is breached, mitigation and response services are available.
Educators Legal Liability

Insurance Carrier:

Policy Limits:

  • $900,000 Each Claim, Including Defense Costs;
  • $900,000 Annual Aggregate, Including Defense Costs. 

Deductible:

  • $100,000 each Claim.

Coverage Provided:

  • This is a claims made policy that provides the University, faculty, administrators, employees, officers, volunteer workers, interns, teaching assistants, and student teachers protection against liability claims made individually or collectively, for actual or alleged neglect or breach of duty, errors, misstatements, acts, or omissions.
  • Provides reimbursement for legal defense costs and payment for settlement costs, to the extent to which they are legally allowed under law, for claims which may arise from age, sex, race, religious, national origin, and employment discrimination, during the policy period.

Coverage Provided:

  • Excess amounts over General Liability, Automobile Liability and Educators Legal Liability policies. Increases the University's protection by providing higher limits to provide for reimbursement of legal expenses and settlement amount/expenses from alleged liability of the University and its officers and employees as a result of personal injury and property damage.
Foreign Liability

Insurance Carrier:

             Foreign General Liability:

  • $2,000,000 General Aggregate; 
  • $10,000 Medical Expense. 

             Foreign Auto Liability (Hired/Non-owned Vehicles):

  • $1,000,000 Combined Single Limit Each Occurrence;
  • $10,000 Medical Expense.

             Foreign Travel Accident and Sickness:

  • $25,000 Accidental Death & Dismemberment (Principal Sum);
  • $10,000 Accidental & Sickness Medical Expenses ($250 deductible);
  • $100,000 Emergency Medical Evacuation;
  • $100,000 Emergency Family Travel Each Insured ($100,000 policy limit);
  • $25,000 Repatriations of Remains Each Insured ($100,000 policy limit).

Coverage Provided:

  • Legal defense costs and settlement amounts for liability claims arising from suits brought against the University for acts occurring outside the United States. Applies to employees while traveling abroad, (excluding certain foreign countries where a United States of America Department of State ban is in effect), as part of University sponsored and approved foreign teaching tours, foreign study tours or programs, and field trips.
General Liability

  • $1,000,000 Each Occurrence Bodily Injury and Property Damage;
  • $1,000,000 General Aggregate Limit;

Deductible:

  • $100,000 per Occurrence.

Coverage Provided:

  • Legal defense and settlement costs for bodily injury or property damage liability claims arising from University premises and/or University operations. Covered under this program are all University officers, employees, authorized volunteers and students acting within the course and scope of their duties as such. 
Real and Personal Property

Insurance Carrier: 

  • Inter-University Council - Insurance Consortium (IUC-IC) Property Pool;
  • Lexington Insurance Company: First & Second Excess.

Policy Limits:

  • $250,000 Per Occurrence/$700,000 Aggregate - IUC-IC Property Pool;
  • $100,000,000 First Excess (dedicated limit to UT);
  • $900,000,000 Second Excess (shared limit with IUC-IC);
  • Various sublimits apply.

Deductible:

  • $100,000 per Occurrence.

Coverage Provided:

This broad form all risk policy protects the University for direct physical loss or damage, (including flood and earthquake), to its real or personal property from such perils as fire, windstorm, lightning, hail, explosion, and theft. Property losses are paid from the IUC-IC self-funded retention pool after the applicable deductible has been paid.  A property loss which exceeds $350,000 will be paid by the commercial insurance company.  Coverage from losses due to flood and earthquake are included up to limits of $100,000,000, but with a $10,000,000 sublimit for Zone A buildings.  An additional $15,000,000 sublimit is purchased, raising Zone A building coverage to $25,000,000. 

Workers' Compensation

 Insurance Carrier:

  • The State of Ohio. 

Policy Limits:

  • Statutory.

Deductible:

  • $0.

Coverage Provided:

  • The Ohio Bureau of Workers' Compensation insures the University for all medical and wage compensation losses as the result of employee work-related injury or disease claims.  Health Management Solutions, a Bureau certified Managed Care Organization (MCO), authorizes injured employees' medical treatment.  The Bureau of Workers' Compensation allows or disallows claims and issues payment for any lost time wages.
