LAWG - 9030 ADMINISTRATIVE LAW
[3 hours] Legislative, executive and judicial controls of administrative actions, with emphasis on
judicial review of decisions of administrative agencies. The course deals primarily with federal administrative decisions and the
Administrative Procedure Act.
LAWG - 9040 AGENCY/PARTNERSHIP
[2-3 hours] A study of non-corporate business entities and the ability of employees and other
individuals to bind the business. The course also examines issues of statutory interpretation through its analysis of state laws regulating
business.
LAWG - 9110 COMMERCIAL PAPER
[2-3 hours] The emphasis of this course is upon commercial paper (Article 3 of the Uniform Commercial Code)
and bank deposits and collections (Article 4 of the Uniform Commercial Code). There are no prerequisites for this course.
LAWG - 9140 CORPORATIONS
[3-4 hours] An introduction to the fundamentals of the corporation and corporate law, including the
nature of the corporate form, the formation process, limitations on limited liability, management and control, fiduciary duties and shareholder
derivative litigation. Emphasis is on state corportate law and the closely held corporation, though the general nature of the federal
securities law overlay (particularly Rule 10b-5) and the key points of divergence with respect to publicly held corporations are identified.
LAWG - 9210 CRIMINAL PROCEDURE-INVESTIGATIONS
[2-3 hours] A study of the constitutional and statutory limitations on the conduct of
criminal investigations and related matters. Includes a discussion of the Fourth Amendment prohibition against unreasonable searches and
seizures, the Fifth Amendment privilege against self-incrimination and the Sixth Amendment right to counsel. It is recommended, but not
required, that Criminal Procedure-Investigations be taken prior to taking Criminal Procedure-Adjudications.
LAWG - 9310 EVIDENCE
[3-4 hours] The rules and policies governing the trial court�s fact finding process with emphasis on rules
relating to admissibility and exclusion of evidence. Relevancy, judicial notice, examination and cross-examination, the hearsay rule and
its exceptions, burdens of proof and presumptions and exclusionary rules involving privileges are among the topics considered.
LAWG - 9400 FAMILY LAW
[3 hours] The interaction of law and the family and the consequences of state intervention in family
relationships. Some of the subjects surveyed are adoption, child custody after divorce, the marriage relationship, de facto marriage, the
termination of marital status, economic consequences of divorce and the role of the lawyer as counselor.
LAWG - 9500 FEDERAL INCOME TAXATION
[4 hours] After a brief consideration of the federal income taxation system, this course
examines the conceptual problems in defining �income.� A detailed treatment of the more significant personal and business deductions,
exemptions and credits follows. Statutory methodology and policy considerations (including the �tax expenditure� concept) are developed
integrally with substantive topics. In addition, the course considers the tax treatment of gains and losses from the disposition of
property, including the capital gains preference and deferral of taxation. Tax shelters and attempts by Congress and the Internal Revenue
Service to limit their utilization may be explored as well.
LAWG - 9550 FIRST AMENDMENT
[2 hours] A study of the Supreme Court�s interpretation of the first amendment clauses concerning
freedom of speech and of the press, and of the amendment�s religion clauses.
LAWG - 9610 SECURED TRANSACTIONS
[3 hours] Commercial finance under Article 9 of the Uniform Commercial Code. There are no
prerequisites for this course.
LAWG - 9710 TRUSTS AND ESTATES
[3 or 4 hours] The study of decedents� estates and trust law. Intestate succession, the law
of wills, estate administration, formation and administration of trusts and future interests are studied. Common law approaches are
contrasted with Ohio and Uniform Probate Code practices.
