Professor Nicole Porter Publishes Disability Law Casebook

Toledo Law Professor Nicole Porter published a new textbook, Disability Law: Cases and Materials with co-author Stephen Befort of The University of Minnesota Law School.  It was released in November 2016 as part of West Academic’s American Casebook Series.

The casebook’s topics are wide-ranging and include disability law as related to employment, government services, public accommodations, and education. Readers will become acquainted with both the Americans with Disabilities Act (ADA), Section 504 of the Rehabilitation Act, and the Individuals with Disabilities Education Act (special education services).

Furthermore, the text is unique in that it includes many cases decided after the ADA Amendments Act of 2008 dramatically increased the ADA’s coverage. It also provides a more robust coverage of disability discrimination in employment, so much so that the book could be used either in a general disability law course or a specialized course focused on disability discrimination in employment.

”We’re thrilled to have Professor Porter join the ranks of our faculty casebook authors,” said Geoffrey Rapp, the College’s Associate Dean for Academic Affairs. “Her scholarly work on disability law has generated great interest among judges, lawyers, and teachers of the subject, and I expect the book will be very well-liked by students.”

A member of the faculty since 2007, Porter teaches courses in employment discrimination, disability law, criminal law, contracts, higher education law, and feminist legal theory.  Her research interests include the employment rights for women and people with disabilities.

“I was excited to be asked to work on this project with my co-author, Steve Befort,” said Porter. “I have been teaching Disability Law for 12 years and I frequently write about disability discrimination in employment. Having completed the book, I’m much more cognizant of all the ways that institutional structures and barriers can affect the lived experiences of individuals with disabilities.”

Professor Porter becomes the sixth faculty member actively teaching at the College to have published a law school casebook.  Professor Lee Strang is an author of Cases and Materials on Federal Constitutional Law (Carolina Academic Press). Professor Joseph Slater is an author of two casebooks, Public Sector Employment: Cases and Materials (West) and Labor Law in the Private and Public Sectors: Cases and Materials (LexisNexis).  Distinguished University Professor William Richman authored Conflict of Laws: Cases, Materials and Problems (LexisNexis).  Distinguished University Professor Susan Martyn is an author of a leading legal ethics casebook, Traversing the Ethical Minefield: Problems, Law, and Professional Responsibility (Aspen).  Dean Benjamin Barros is an author of Property (Aspen).
