DEPENDENTS
Overview
-
- Your spouse and/or unmarried children under the age of 21 may join you in the U.S. as your dependents in H-4 status. If the dependent is outside of the U.S., he or she may apply for an H-4 visa stamp at a U.S. embassy or consulate on the basis of your H-1B Approval Notice and proof of their relationship to you.
- If the dependent is currently in the U.S. under a different immigration status or needs an extension of existing H-4 status, the dependent should apply for a change to/extension of H-4 status by filing Form I-539 with USCIS. This form is available at USCIS's I-539 page.
- H-4 dependents are generally not eligible to work in the U.S. They are eligible to study but are not eligible to hold any student employment positions or assistantships that require work.
- Certain H-4 dependent spouses of H-1B nonimmigrants who are seeking employment-based lawful permanent residence may be eligible to apply for employment authorization.
Please note that The University of Toledo does not sponsor the H-4. The application is filed by the dependent (or their guardian), who is responsible for completing Form I-539 and I-539A (if applicable), paying the USCIS filing fees and maintaining and tracking lawful status. As a courtesy, OISSS will review the I-539 and I-539A (if applicable) applications and help the H-1B beneficiary submit the applications to USCIS.
Dependent forms
The H-1B Employee/Beneficiary can complete the Dependent E-Form in iRocket if they want to submit their dependent's I-539 with their H-1B petition. The H-1B Employee/Beneficiary should submit a separate Dependent Form for each dependent. For more information about submitting the Dependent Form, go to the H-1B iRocket User Guide webpages.
