Notice to employees

In radiation protection standards adopted under Chapter 3748 of the Ohio Revised Code, the Ohio Department of Health has established standards for your protection from radiation sources which are required to be licensed/registered with the Ohio Department of Health.

University of Toledo's responsibility

The University of Toledo is required to:

  • Inform you of the occurrence of radiation or radiation sources and the presence of a restricted area;
  • Instruct you in the hazards associated with exposure to radiation and in precautions or procedures to minimize exposure to radiation;
  • Instruct you in the applicable laws for protection of personnel from exposure to radiation
  • Post or otherwise make available to you a copy of the operating procedures applicable to work under the license or registration;
  • Apply the radiation protection rules to all work involving licensed or registered sources of radiation; and
  • Post notices of violation involving radiological working conditions.

your responsibility as a worker

You should familiarize yourself with those provisions of the radiation protection rules and operating procedures that apply to the work you with which you are engaged.  You should observe their provisions for your own protection, the protection of co-workers, and all others.  If you should observe violations of the rules, or if you have a safety concern, you should report them to your supervisor.

  • Limits on exposure to radiation and radioactive materials in restricted and unrestricted areas;
  • Measures to be taken after accidental exposures;
  • Personnel Monitoring; surveys and equipment;
  • Caution signs, labels, and safety interlock equipment;
  • Exposure records and reports; and
  • Related matters.

The University of Toledo is required to make available to you the information in your dose records (as maintained under the provisions of OAC 3701:1-38-10).  In addition, the University of Toledo is required to provide you with the annual report of the dose you received in that monitoring year if the dose exceeds 100mrem, or if you request an annual report.

Inspections

All activities covered by the ORC 3748 and other radiation protection laws are subject to inspection by representatives of the Ohio Department of Health. ODH inspectors want to speak or talk with you if you are worried about radiation safety or have other safety concerns about licensed/registered activities. Your employer may not prevent you from talking with an inspector. The ODH will make all reasonable efforts to protect your identity where appropriate and possible. If you believe that your employer has not corrected violations involving radiological working conditions, you may request an inspection. Your request should be addressed to the Ohio Department of Health, Bureau of Radiation Protection, and must describe the alleged violation in detail. It must be signed by you, or your representative.

if you are aware of non-compliance or breach of policy or procedure regarding radiation safety, please follow the steps:

  • Step 1: Contact your supervisor and inform them of the issue.  If the issue is not resolved proceed to Step 2.
  • Step 2: Contact the Radiation Safety Officer, Joseph Agosti at Joseph.Agosti@utoledo.edu or 419-383-4301 to relay the issue of concern.  If the issue is not resolved proceed to Step 3.
  • Step 3:
    • If the issue of concern is in a research setting, contact Gary Rafe Ph.D., Research Compliance Analyst and Radiation Safety Committee administration member, at Gary.Rafe@utoledo.edu or 419-530-2227. 
    • If the issue of concern is in a clinical setting and involves radioactive material contact Nicholas Sperling Ph.D., therapeutic medical physicist, and Radiation Safety Committee Chair, at Nicholas.Sperling@utoledo.edu or 419-383-3599.
    • If the issue of concern is in a clinical setting and involves radiation generating equipment, contact Sulaiman Aldoohan Ph.D., diagnostic medical physicist, and X-ray QA Committee member, at Sulaiman.Aldoohan@ utoledo.edu or 419-383-4303.
    • If the issue is not resolved proceed to Step 4.

Discrimination

The University of Toledo is prohibited from firing or otherwise discriminating against you for bringing safety concerns to the attention of your employer or the Ohio Department of Health (ODH) as per ODH HEA Form 5503: Notice to Employees.  Copies of this notice must be posted in a sufficient number of places in every facility where employees are engaged in activities subject to the radiation protection rules of the Ohio Administrative Code to permit employees working in or frequenting any portion of a restricted are to observe a copy on their way to or from their place of employment. OSHA requires 29 CFR 24 Appendix A "Energy Reorganization Act" Poster be displayed when applicable. HEA 5503(Rev. 11/17).
