Family and Medical Leave (FMLA)

The University of Toledo has partnered with FMLASource to manage leaves of absence for UToledo employees. Effective Thursday, July 1, 2021, all FMLA matters will be handled directly by FMLASource.  See eligibility criteria below in the FAQ section before applying.

FAMILY MEDICAL LEAVE OF ABSENCE process

  1. Submit application with FMLASource online or by calling 1.833.955.3388.  Please see FMLASource Website Guide if it's your first time applying
  2. Medical Certification Form from FMLASource will be emailed to your University of Toledo email
  3. Meet with your or your family member's health care provider to complete the form
  4. Submit the Medical Certification Form prior to the certification due date
  5. Decision Letter from FMLASource will be emailed to you to review
  6. Notify department of leave as soon as possible, preferably 30 days prior if planned, but application and medical certification are required to be submitted no later than 15 days after start of the leave
  7. FMLA leave is unpaid.  To recieve a paycheck, employee is required to report sick time use via their timekeeping system (either API, TimeClock, or UT Leave reporting tool)
  8. Continuous leave and reduced hours are recorded by FMLA Source, but employee is required to report intermittent leave usage within 24 hours after time off has been taken

What is Family and Medical Leave?

The Family and Medical Leave Act (FMLA) of 1993 provides up to 12 weeks of unpaid, job protected leave to "eligible" employees for certain family and medical reasons

Who is an "eligible" employee?

Employees who have worked for UToledo for at least 12 months and worked for 1,250 hours over the previous 12 months

What can I take FMLA for?

  • Caring for your child after birth, or placement for adoption or foster care.  All maternity leaves, even for new employees, go through FMLA Source
  • Caring for your spouse, child or parent who has a serious health condition
  • Serious health condition that makes you unable to perform your job
  • Qualifying urgency to be with your spouse, child or parent if that person is an active service member or has an impending call to active duty in support of a contingency operation
  • Caring for an injured service member if that person is your spouse, child, parent or next of kin
  • All Military Leaves go through FMLA Source.  Please see information about Military leaves here.

When do I apply for FMLA?

30 days advance notice is required if the leave is foreseeable

UToledo may require medical certification to support a request for leave because of a serious health condition, and may require second or third opinions (at UToledo's expense) and a fitness-for-duty report to return to work.  If medical certification is required, it will be email to UToledo email

What happens while I'm on FMLA?

UToledo must maintain your health coverage under any group health plan. You will continue to be responsible for your portion of the premium payments if your leave becomes unpaid due to exhaustion of sick and vacation time.  Please call Benefits at 419-530-4747, option #3 if you have questions

What should I expect when I Return?

You will be restored to your original or equivalent position with equivalent pay, benefits and other employment terms. The use of FMLA leave cannot result in the loss of any employment benefit that accrued prior to the start of your leave

Return to work slip, if required, will be emailed to your UToledo email with medical certification.  Once completed, send to FMLA Source.  If you are able to return to work before end of leave, please give your department advanced notice
