Scope and Content Note

Judge John W. Potter deposited this collection in the Ward M. Canaday Center in 2004.  It contains court records and notes, materials from judicial conferences, seminars and workshops, speeches, correspondence, photographs and audio-visual materials, personal and biographical files and printed material.  The majority of materials represent the period of John W. Potter’s service as Judge of the Sixth Appellate District of Ohio (1969-82) and as an active Judge of the United States District Court, Northern District of Ohio, Western Division (1982-2004), with only a few materials relating to his term as Mayor of the City of Toledo (1961-67) or his earlier life.  The largest series consists of sixteen feet of court records, correspondence and notes relating to cases brought before the United States Court of Appeals for the Sixth Circuit and the United States District Court for the Northern District of Ohio Western Division, as well as some cases from the United States District Court for the Eastern District of Michigan Southern Division, the United States District Court for the Western District of Kentucky, the Court of Appeals of the Third Appellate Judicial District of Ohio, and the Court of Appeals of Erie, Fulton, Hancock, Huron, Lucas, Ottawa, Sandusky, Williams and Wood Counties, Ohio.  The sub-series Schedules and Reports includes Court Appointments, Calendars and other materials, much of which amounted to Quarterly Reports for Judge Potter and his court activities.

The materials relating to regional or national (or international) conferences, seminars and workshops include Appellate Judges Seminars for 1969, 1970 and 1972, the Sixth Circuit Appellate District Judicial Conferences for 1977 through 1989, 1991-93 and 1995-2003 (including correspondence of the Committee to Study the Judicial Conference, 1985-95), the Danforth Seminar in 1986, The Federal Judges Association Second Annual National Conference in 1989, The Federal Judicial Center Seminar on Law and Ethics in 1993, the 1990 [Ohio]  Bench-Bar Conference, the Ohio Judicial Conference 1972 and 1980 Annual Meetings, the Point of Law Seminar presented by The Enquirer, The Post and The Cincinnati Bar Association in 1983, Sentencing Institutes in 1983-86, Workshops for Judges of the Sixth Circuit (and other Circuits) for 1982 through 1997, 1999 and 2001, and the University of Windsor (Ontario, Canada) Faculty of Law’s Judicial Intellectual Property Law Seminar in 1991.

The series of the speeches of Mayor/Judge Potter includes groupings of  “Introductions, Memorials, Roast or Retirement Party, Swearing In Ceremonies, Testimonial Dinner Speeches,” “Naturalization Ceremony Speeches” and “Seminars.”  Potter’s numerous speeches are represented by at least 230 distinct examples of drafts and used copies (usually typewritten, but often heavily annotated) of public presentations at various events in Toledo or across Ohio from 1962 to 2004, with at least five speeches pre-dating his becoming a judge.  Besides
documenting the development of Judge Potter’s often-noted “folksy” style and sense of humor, these speeches provide a range of topics reviewing early legal and medical practice, area history, personal information about individuals being honored, and topical references over the four decades covered.  Of special note are the forty-six sets of Judge Potter’s remarks at Naturalization Ceremonies at which he officiated, from 1982 through 2004, which he clearly regarded quite seriously, often referring to his father’s immigration from England.

The additional correspondence files mainly represent the period of Judge Potter’s service as a federal judge until his “retirement” (1982-92).  These topics include the American Bar Association, District Judges Association, Federal Judges Association and Toledo Bar Association, Building and Staff matters, Judge Potter’s political campaigns of 1974-77 and 1980-81, and several projects or institutions with which Potter was especially involved, such as the local Art Festivals (1966, 1976, 1979-81 and 1983), the Committee on Relations with Toledo, Spain (Toledo, Ohio’s first Sister-City) (1971-82), Promenade Park Arts Committee (1979-80), and the Toledo Zoo (1979-82).

The audio-visual (photographic) material consists of four prints (including one showing John Potter as Mayor and one showing him on the Bench as Judge), with a reel audio recording of his Swearing In Ceremony (presumably as Judge).

The Personal and Biographical files include several versions of Judge Potter’s resume and a ten-page typewritten memoir of his service in the Second World War written in 2005, which includes a photograph of John Potter in France in the Fall of 1944, as well as a local
newspaper account re-telling much of the same story.  Also included are Potter’s Alpha Kappa Psi (Gamma Eta Chapter, University of Toledo) Civic Award from 1966, several others Certificates of Appreciation, and the Program and Proceedings from The Honorable John W. Potter Portrait Presentation to the United States District Court Northern District of Ohio, July 26, 2002.

The printed material includes copies of the Ohio Judicial Conference The Ohio Judge Directory (Spring 1981), the  Toledo and Lucas County Bar Associations’ Attorneys’ Relative Value Guide (1972), The Toledo Bar Association Official Bar Directory of Lucas County, Ohio (1969, 1970, 1971-1972, 1972-1973 and 1976-1977) and The Toledo Bar Association Toledo-Lucas County Bar Directory (1977-1978 and 1978-1979), which include a Pictorial Directory from 1970 on, and Telephone Directories for the  Lucas County Courthouse (1969, 1972, 1973, 1976-1977 and 1980), as well as occasional examples of various publications, including the issue of the Toledo Bar Association Newsletter (1979) containing Judge Potter’s article “Prehearing Conferences—A Report on a New Approach.”

The Miscellaneous series includes examples of sources of humor evidently collected for speeches, papers not otherwise associated with others, a note including a political campaign button reading “Re-elect POTTER Mayor,” and a Plan for the re-development of one block of downtown Toledo prepared for Mayor Potter. In addition to the wealth of material on the judicial/legal system and particular cases during the three decades or more represented, local historians should find the correspondence and speech files useful for information about various city or regional organizations and other persons mentioned.

Contains court records, correspondence and notes relating to cases from at least April 9, 1969 through August, 2004.  The case records are filed alphabetically.  Users seeking a particular case should search under the names of all known parties due to inconsistencies in naming the cases in the documents. Jury instructions for each case are included within the case files attached to the case it pertains to coincide with.  (Numbers have been alphabetized as if spelled out.  Both “In re:” and “In the matter [of]…” cases are filed respectively as a group (and include cases filed separately by names), “Co.” with “Company,” “St.” with “Saint,” “United States” and “USA” filed with “United States of America,” vs.” with “v,” “&” with “and,” while due to inconsistencies, “United States of America et al.” and “United States of America etc.” are inter-filed with “United States of America.”)  Types of records include: Court’s Instructions to the Jury, Exhibit Lists, Findings of Fact and Conclusions of Law, Judgments, Memoranda, Notices of Appeal or Cross-Appeal, Opinions, Orders, and Summaries of Indictments.  Records and notes relating to Sentences and Pleas and Trial Notes are filed separately, as these are not as clearly distinguishable as to specific cases.  The sub-series Schedules and Reports includes files on “Administrative Orders,” “Bankruptcy Court,” “Crime and Punishment,” “Local Rules” and “Proposed Amendments to Local Rules” (memoranda, 1983-91), “Naturalization Proceedings, Questions, Schedules, Addresses by Petitioners, Notes and other Correspondence,” “Sentencing Guidelines,” and “Summary Jury Trial,” as well as
