Consent

The University of Toledo’s Title IX Office defines consent as, “knowing and voluntary, and with clear permission by word or action to engage in sexual activity.” Consent requires unambiguous communication and mutual agreement concerning the act throughout the entirety of sexual activity. Consent can be withdrawn once given; consent to some sexual contact (I.e. kissing) cannot be presumed as consent to other sexual contact (I.e. sex). A person cannot consent if they are unable to understand the sexual situation or are disoriented, helpless, asleep, or unconscious, for any reason including by alcohol, drugs, or medication. A person cannot give consent if force, intimidation, threats, or duress are used.
